HSE LOLER Call for Evidence — Formal Response Published

The HSE has published its formal response to the October 2025 Call for Evidence on LOLER 1998. Here's what it means for duty holders.

176

Responses received

59%

Said LOLER remains fit for purpose

64%

Said the ACoP remains fit for purpose

65%

Said regulations are not unnecessarily duplicative

No legislative reform at this stage

The evidence did not demonstrate a clear or proportionate case for legislative change. LOLER 1998 and ACOP L113 remain fully in force.

Guidance updates instead

Improvements will be delivered through clearer guidance and ACoP updates rather than new legislation — helping businesses with compliance.

Competency & digital tools

HSE confirmed that competent persons may use digital diagnostics and AI-enabled tools to support professional judgement where statutory requirements are met.

Current position for duty holders

LOLER remains in full force

LOLER 1998 and ACOP L113 are unchanged. All existing thorough examination requirements, intervals and record-keeping obligations continue to apply.

Compliance as usual

Duty holders must maintain standard compliance, keep thorough examination records up to date, and properly plan all lifting operations.

Watch for guidance updates

HSE will update guidance and continue structured engagement with industry. No legislative changes are anticipated in the near term.
